Welcome to Big Sky!  Lone Mountain Land Company manages the planning, building, marketing, and sale of premier real estate communities in and around Big Sky, Montana.  Our company supports world-class club operations at Spanish Peaks Mountain Club and Moonlight Basin, while overseeing real estate activities at those clubs and additional projects in the Big Sky region. We are committed to visionary, thoughtful development that embraces sustainability, respects the environment and focuses on the truly exceptional. In this policy, “LMLC,” “we,” “us,” and “our” refers to Lone Mountain Land Company and any affiliated entity responsible for the collection, use, and handling of personal data through our website.    

We operate our website (https://www.lonemountainland.com/home and any linked webpages operated by an affiliate of LMLC, our “Site”) to provide you with information about our ongoing projects and future plans, connect you with our affiliated foundations and various Big Sky community resources, allow you to browse our current real estate listings, and enable you to contact us directly.  We don’t sell your personal information.  When we collect personal information about you through our Site, we use that information to improve your experience and our services, contact you about current real estate and investment opportunities, answer your questions, and trouble-shoot problems.  You can find more information about what types of personal information we collect and what we do with it in this policy.  

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.  If you do not agree with this privacy policy, you should not use our Site or any features or functionality available through our Site.  We update this policy from time to time, so you should check back regularly for updates.  Your continued use of this Site after we make changes is deemed to be agreement to and acceptance of those changes, so please check this policy periodically for updates.

This policy does not apply to information collected by us offline (when you interact with our employees in person or over the phone) and it does not apply to websites we do not own or control, even if we have provided a link to that website for your information or use.  

Although we live and work in Big Sky, Montana, we know that not all visitors to our Site are Montana residents.  Without conceding that we have a legal obligation to comply with the laws of your home country or state, we want you to know that we are committed to protecting your personal information.  If you have a question or concern about what we have covered in this policy, please contact us!  We will do our best to address whatever concerns you may have.  

For purposes of this policy, “personal data” means any information that is linked or reasonably linkable to an identified or an identifiable individual.  Different states and countries use different definitions of “personal data” or “personal information.”  Because we call Montana home, we use the definition in Montana’s Consumer Data Privacy Act.  Common examples of personal data include your name and address, email address, registration and contact information, billing and payment information, and data about the device you are using to access our website or services.  The personal data we collect depends on the extent of your interactions with our Site, the features you use, and applicable law.  The categories of personal data we collect can include the following:

Individual Identifiers.  Identifiers such as your name, mailing address, unique personal identifier or user name, internet protocol (IP) address, email address, phone number, date of birth, and other similar identifiers.  

Business Affiliation.  Data associating you with an organization or business, such as a business name in your IP address.

Usage Data.  Data generated by your activity on our Site, including the following:

·       Interactions.  Data about your interactions with the Site, including the time and date of your visit, the webpages you view and the amount of time you spend on each webpage, your use of any of the features or services we offer (including those provided by our third-party vendors and partners), and any content that you download or stream.

·       Devices and Configuration Data.  Data about your device and your device configuration, such as the domain name of your Internet Service provider, the IP address assigned to the computer you are using to access the Internet, the name and version of your web browser, and your computer’s operating system and platform.

·       Error Reports and Performance Data.  Data concerning the performance of our Site, including any problems or errors you may experience. 

Internet or Other Electronic Network Activity Information.  Data collected through the use of cookies, tags, tracking pixels, or similar technology about your browsing history, search history, and interactions with our websites and advertisements.  These technologies are saved by your computer and will recognize your device in the future.  If you return to the site that placed the cookie, it can remember you from your last visit and keep track of your activity over time.  Cookies collect information about the pages you view and your activities on our website, help us keep track of your preferences, customize your browsing experience, and deliver specific ads or offers to you.  You can find out more about cookies here: https://allaboutcookies.org/what-is-a-cookie.

We also use Cloudflare and Stripe to maximize network resources, manage traffic, and protect our Site from malicious traffic.  There are cookies associated with each of these services.  For example, Cloudflare provides a bot solution to identify and mitigate automated traffic to our Site.  To do this, Cloudflare places a cookie (“_cf_bm”) on your device.  The cookie contains information related to the calculation of Cloudflare’s proprietary bot score and, in some cases, a session identifier.  We also use Cloudflare to set a rate limiting rule for our Site, which regulates traffic when multiple unique visitors share the same IP address.  Cloudflare uses a cookie (“_cfuvid”) to distinguish individual users.  You can find out more about the cookies set in connection with Cloudflare’s services here: https://developers.cloudflare.com/fundamentals/reference/policies-compliances/cloudflare-cookies/.

Although we are not collecting payments through our Site, several of our pages incorporate Stripe’s advanced fraud detection cookies (“_stripe_mid” and “_stripe_sid”).  We use these cookies to collect information about your device characteristics and activity indicators to distinguish legitimate visitors from automated bots.  You can learn more about Stripe’s advanced fraud detection services here: https://docs.stripe.com/disputes/prevention/advanced-fraud-detection.  

In connection with our promotion of our current real estate listings and leasing opportunities, we collect information about your interactions with our project-specific and real estate webpages (including, without limitation, all webpages associated with the Big Sky Real Estate Company).  Google Analytics uses a set of cookies to collect information about the visitors to these pages, which Google then reports back to us as site usage statistics.  When Google provides us a report, it does not personally identify individual visitors.  However, Google does place persistent cookies on your device. The main cookie used by Google Analytics (“_ga”) allows Google to distinguish one visitor from another and lasts for two years.  These webpages also incorporate cookies and similar technologies used to measure ad and campaign performance and conversion rates for Google Ads.  For example, the Big Sky Real Estate Company page uses several cookies that start with “_gcl_” to help us determine how many times users who have clicked one of our ads end up taking an action the Site, such as searching for a specific listing.  You can find out more about Google’s advertising and measurement cookies here: https://business.safety.google/adscookies/.

Our Site contains plug-ins and other features that integrate third-party social media platforms, like Facebook, Instagram, X, and YouTube.  You can activate these plug-ins manually by clicking on the icons located in the lower left-hand corner of our homepage.  If you do so, the collection and use of your personal data is subject to each company’s privacy policies.  We have no control over the collection and use of your information by Meta (Facebook and Instagram) or X, should you elect to leave our homepage and visit their sites. 

For your convenience, additional hyperlinks may be posted on our Site that link to external websites we do not control.  We are not responsible for, and this policy does not apply to, the privacy practices of other companies.  You should not assume that our policy applies to any external sites, or that the policies applicable to those sites are similar to ours.  You will need to review each site’s privacy policy to understand how your personal data will be collected and used by the owner of the site.

Consumer Rights Requests.  You may contact us with a request to access, correct, delete, or obtain a copy of your personal data at the email address below.  Please include “Privacy Rights Request” in the subject of your email.  If we are in possession of your personal data, we will confirm receipt of your request and contact you to verify your identity.  The method by which we will verify your identity may vary, depending on the type and sensitivity of your personal data, the risk of harm to you, and the technology available to you.  If we cannot verify your identity with reasonable certainty, we will deny your request and inform you that your identity could not be verified.  Although you are under no obligation to cooperate with our efforts to verify your identity, we cannot act on your request until you have done so. 

Please do not send us any sensitive personal information as part of your request.  Should we require any information beyond your name and account number, we will contact you to discuss a secure and reliable means of transmitting that information to us. 

Our resolution of your request will depend on the nature of the personal data and the purposes of our processing of your data.  We reserve the right to decline your request if we are unable to authenticate your identity, if we have a good faith, reasonable, and documented belief that your request is fraudulent, or if your request exceeds what is required of us under applicable law.  We may elect to fulfill your request without conceding the applicability of any legal requirement that would require us to do so. 

Browser-Based Controls.  Your browser may include certain features that will assist you in controlling the collection and use of your personal information.  These features may include:

·       Browser Controls for “Do Not Track.”  Some browsers have incorporated “Do Not Track” features that can send a signal to websites you visit indicating that you do not wish to be tracked.  Because there is not yet a common understanding of how to treat these signals, you should use the “Do Not Track” feature in conjunction with another form of opt-out.  Many websites still collect and use your browsing data to improve security, provide content, services, ads and recommendations on their websites, and generate reporting statistics.

We strive to be as open and transparent about our data collection and processing as possible.  As our Site and the associated features and functionality evolve, we will make updates to this policy.  When we post changes to the policy, we will post the date of the latest update at the top.  If there are material changes to the policy, such as a change to the processing of your personal data that is not consistent with the purpose for which it was originally collected, we will notify you by either (i) posting a prominent notice of such changes to our Site before they take effect; or (ii) by sending you a direct notification, via email or your last contact address on file.
